Is Delta 8 THC Legal in Ohio?

Delta 8 THC is allowed in the State of Ohio. Though Delta 8 is federally legal due to the 2018 US Farm Bill which made industrial hemp-derived products like CBD and Delta 8 THC legal (as long as the Delta 9 contents remain under the .3% Delta-9 THC threshold), some US States like Ohio have their own laws regarding these products in the state. Unlike CBD, Delta 8 is psychoactive and will get you high. Let’s look at how buying and selling this product are handled by Ohio law first.

Delta 9 THC Ohio Laws

Since Delta 8 is so close to the main psychoactive cannabinoid found in hemp, Delta-9 THC, we first start with how the state views this form of Tetrahydrocannabinol (THC) in the state.  Federally, Delta-9 THC is limited to .3% as measured on a dry weight basis.  The State of Ohio doesn’t have other restrictions which would limit users from experiencing this psychoactive cannabinoid.

Industrial Hemp is defined and permitted to be federally legal in the 2018 Farm Bill, which was signed into law on December 20th in 2018.  For example, let’s take a gummy with six grams of Delta 9 THC. With 1g = 1000mg, .3% of 1000mg is 3 mg so every 1 gram of Delta 9 has the potential to contain 3 mgs of Delta 9. Now take a 6 g gummy which can have (6g*3mg=) 18mg of Delta 9 THC.  Hemp products that fall under this definition are legal, as long as they contain less than 0.3 percent Delta 9 THC by dry weight volume.

Therefore residents in the state can buy products from a Delta 9 shop and enjoy the euphoric effects contained within the products.  This is also promising because it not only allows the sale of THC without the need to visit a dispensary, but it also sets the precident for how the state may view other forms of THC within state borders.

List of controlled substances

Hallucinogenic substances along with the possession of marijuana remain Schedule I Drugs in the state, though Louisiana has exempted hemp-derived products such as Delta-8-THC from the Controlled Substances list. This means that as long as Delta-8-THC is derived from industrial hemp, it is legal in Louisiana.
